Rumble in the Wall St jungle: Ackman, Icahn duke it out on TV
NEW YORK (Reuters) - Two of the most prominent investors in the world, Carl Icahn and Bill Ackman, had Wall Street mesmerized on Friday as years of acrimony exploded into a bruising verbal scrap on live TV.
Initially CNBC was only talking to Ackman, but then the cable TV station put Icahn on as well and all hell broke loose.
The argument centered on nutritional supplements company Herbalife Ltd
Icahn, 76, who has gone from feared corporate raider to activist investor in more than three decades of dealmaking, called Ackman, 46, a "liar" and "the most sanctimonious guy I ever met in my life."
In a tirade that included expletives, Icahn said he would never invest with Ackman and predicted investors in his Pershing Square hedge fund would lose a lot of money on the Herbalife bet. U.S. news outlets have reported that Icahn has a long position in Herbalife, although he has not confirmed that.
Ackman, who is usually much more restrained than Icahn when speaking publicly, got in a few verbal shots himself. Icahn "does not have a good reputation" and "is not an honest guy," he said.
The altercation quickly became the talk of the financial world, both on trading floors and on Twitter.
"I will never delete today's Ackman vs Icahn CNBC debate from my DVR. Even when DVRs are like Betamaxes, I'll force my grand kids to watch," tweeted Eric Jackson of hedge fund Ironfire Capital LLC.
Business Insider Deputy Editor Joseph Weisenthal tweeted: "It's never going to get any better than what we just saw."
The influential blog ZeroHedge called it the "Ultimate Hedge Fund Deathmatch: Icahn And Ackman As The Real Billionaire Husbands Of CNBC Going Wild."
BusinessInsider held an online poll: "Who Won The Brawl Between Carl Icahn And Bill Ackman?" As of 5 p.m. New York time, 70 percent of the more than 1,800 people who voted declared Ackman the victor.
Neither Ackman nor Icahn could be reached for comment after the CNBC show.
Ackman has called Herbalife a "well managed pyramid scheme" that he predicted will collapse. Herbalife has denied the allegation.
"On CNBC today, Mr. Ackman continued to misrepresent Herbalife," an Herbalife spokeswoman said on Friday.
"Herbalife is a financially strong and successful company, having created meaningful value for shareholders, significant opportunities for distributors and positively impacted the lives and health of our consumers over our 32-year history."
DECADE-OLD DISPUTE
The genesis of their feud stems from a nasty contractual dispute involving a real estate company deal 10 years ago, when Ackman was running his former hedge fund, Gotham Partners, which he co-founded in 1993 with former Harvard Business School classmate David Berkowitz.
After eight years of litigation, a court ruled in Ackman's favor and Icahn was forced to pay Gotham $4.5 million, plus interest.
Indeed, the discussion on CNBC often had little to do with the merits of Ackman's view of Herbalife. At times, Icahn also feuded with CNBC host Scott Wapner, accusing him of "bullying" him when he was pressed on whether he had gone "long" on Herbalife shares.
Icahn may have little to lose from the dustup given that he is simply managing his own money these days. Ackman, on the other hand, manages about $11 billion at Pershing Square, including money from many prominent institutional investors.
Herbalife shares briefly surged over 5 percent when Icahn said during the row that Ackman, by going public with his big short position, would cause the "mother of all short squeezes" in the stock.
A short squeeze is when short sellers are forced to cover their position, a move that pushes a stock higher.
Ackman and Icahn's dislike of each other is well known in financial circles. Some of the tension stems from the fact they both specialize in the same game - taking big positions in companies and agitating for management changes.
Ackman's bet against Herbalife is also being challenged by another big hedge fund player, Third Point manager Daniel Loeb, who has said he holds a big long position on the stock.

Most unknown species can be named
Most of the world's plant and animal species could be named before they go extinct, say researchers.
Writing in the journal Science, the researchers said it could be achieved this century.
This is largely a result of an increase in taxonomists - the people who describe species new to science.
The scientists acknowledge that although there is an extinction crisis, they say the rates are lower than previously thought.
Discovering and naming the world's species is critical for their conservation and can be done with only a modest increase in effort, the researchers stated.
But they also recognised it will be difficult to maintain a high rate of discovery as it becomes harder to find rare species.
Previous overestimates of the number of species - some as high as 100 million, led some in the scientific community to believe that it would be impossible to name all the world's species before they go extinct.
Naming a species gives formal recognition to its existence, making conservation easier, said lead author, Associate Professor Dr Mark Costello, from The University of Auckland.
"We believe that with just a modest increase in effort in taxonomy and conservation, most species could be discovered and protected from extinction."
As more information on taxonomy is available to the public via the internet, amateur as well as professional taxonomists are increasing, especially in regions such as Asia and South America, which are rich in biodiversity.
"We've discovered three times more people now naming species than there were ever before. We're in the golden age of taxonomy," added Dr Costello.
He hopes that this increase will continue, and that the public become more involved.
There are currently around around 1.5 million species which have been named. Dr Costello and his colleagues estimate the total number species on Earth ranges from two to eight million.
"Overestimates of the number of species on Earth are self-defeating because they can make attempts to discover and conserve biodiversity appear to be hopeless," said Dr Costello.
Jean-Christophe Vie, deputy director of the International Union for Conservation of Nature species programme, disagrees with the review's conclusion that "species are more likely to be described than become extinct".
"Extinction is usually underestimated. It's more important to fight extinction than to describe or catalogue all species," he said.
"We can protect species even if we don't know all of them. I have no doubt we can catalogue all of life, and it would be useful, but we don't have the luxury of time."
"I am worried by the message implying that to conserve species you need to know everything about them. You can do a lot of protection even in the absence of knowledge."
To reduce the time it takes to name the world's species, Dr Costello and colleagues recommend more taxonomists to be employed, increased financial support and international coordination in the scientific community to share expertise.
Professor Georgina Mace, from the Centre for Population Biology at Imperial College London, welcomes the analysis but also questions whether we really need to know the names of all species.
"Its excellent news, that taxonomic expertise is moving very effectively to tropical countries where most of the biodiversity on Earth is," she said.
She added that with sensible sampling, conservationists can prioritise effort on groups of species that are disappearing in the places most under threat.
"Once you've done that you can put in place conservation actions that will benefit everything there, whether named or not."
"It is part of our cultural responsibility to have looked at every single species on Earth, but because it can be difficult to do - particularly the last few percent - we need to be quite strategic about the effort put into discovering, describing, monitoring and conserving."
The levels of investment needed to name all the species is very modest, in global terms, said Professor Ken Norris, director of centre for Agri-Environmental research at Reading University.
He added that many species play important functional roles in the way Earth works and the life support systems they provide.
"If we lose them, important functions of those systems - like purifying water, providing fertile soils and clean air - might be damaged without us realising what we've lost," Prof Norris explained.
"Extinction isn't just about losing part of Earth's evolutionary history, it might also involve fundamental changes in the Earth's ecosystems that may have detrimental effects on mankind."

Right target, but missing the bulls-eye for Alzheimer's
Jan. 23, 2013 ? Alzheimer's disease is the most common cause of late-life dementia. The disorder is thought to be caused by a protein known as the amyloid-beta protein, or Abeta, which clumps together in the brain, forming plaques that are thought to destroy neurons. This destruction starts early, too, and can presage clinical signs of the disease by up to 20 years.
For decades now, researchers have been trying, with limited success, to develop drugs that prevent this clumping. Such drugs require a "target" -- a structure they can bind to, thereby preventing the toxic actions of Abeta.
Now, a new study out of UCLA suggests that while researchers may have the right target in Abeta, they may be missing the bull's-eye. Reporting in the Jan. 23 issue of the Journal of Molecular Biology, UCLA neurology professor David Teplow and colleagues focused on a particular segment of a toxic form of Abeta and discovered a unique hairpin-like structure that facilitates clumping.
"Every 68 seconds, someone in this country is diagnosed with Alzheimer's," said Teplow, the study's senior author and principal investigator of the NIH-sponsored Alzheimer's Disease Research Center at UCLA. "Alzheimer's disease is the only one of the top 10 causes of death in America that cannot be prevented, cured or even slowed down once it begins. Most of the drugs that have been developed have either failed or only provide modest improvement of the symptoms. So finding a better pathway for these potential therapeutics is critical."
The Abeta protein is composed of a sequence of amino acids, much like "a pearl necklace composed of 20 different combinations of different colors of pearl," Teplow said. One form of Abeta, Abeta40, has 40 amino acids, while a second form, Abeta42, has two extra amino acids at one end. Abeta42 has long been thought to be the toxic form of Abeta, but until now, no one has understood how the simple addition of two amino acids made it so much more toxic then Abeta40.
In his lab, Teplow and his colleagues used computer simulations in which they looked at the structure of the Abeta proteins in a virtual world. The researchers first created a virtual Abeta peptide that only contained the last 12 amino acids of the entire 42-amino-acid-long Abeta42 protein. Then, said Teplow, "we just let the molecule move around in a virtual world, letting the laws of physics determine how each atom of the peptide was attracted to or repulsed by other atoms."
By taking thousands of snapshots of the various molecular structures the peptides created, the researchers determined which structures formed more frequently than others. From those, they then physically created mutant Abeta peptides using chemical synthesis.
"We studied these mutant peptides and found that the structure that made Abeta42 Abeta42 was a hairpin-like turn at the very end of the peptide of the whole Abeta protein," Teplow said.
The hairpin turn structure was not previously known in the detail revealed by the researchers, "so we feel our experiments were novel," he said. "Our lab is the first to show that it is this specific turn that accounts for the special ability of Abeta42 to aggregate into clumps that we think kills neurons. Abeta40, the Abeta protein with two less amino acids at the end of the protein, did not do the same thing."
Hopefully, the work of the Teplow laboratory presents what may the most relevant target yet for the development of drugs to fight Alzheimer's disease, the researchers said.
Other authors on the study included Robin Roychaudhuri, Mingfeng Yang, Atul Deshpande, Gregory M. Cole and Sally Frautschy, all of UCLA, and Aleksey Lomakin and George B. Benedek of the Massachusetts Institute of Technology.
Funding for the study was provided by grants from the State of California Alzheimer's Disease Research Fund, a UCLA Faculty Research Grant, the National Institutes of Health (AG027818, NS038328) and the James Easton Consortium for Alzheimer's Drug Discovery and Biomarkers.

Walmart Explores Offering Private Health Insurance for Small
Once again I am here to sing the praises of Walmart. Over the years I have done so on many occasions.
Many misguided souls take the other side. They blame Walmart for ruining mom and pop grocery stores, mom and pop hardware stores, etc.
Not me, I praise cheaper prices. Moreover, it's what consumers voted for with there hard-earned dollars.
If anyone wants to pay more for stuff, all they have to do is shop at a mom and pop hardware store, grocery store, or pharmacy. Most don't because they want a bargain.
Today, I have good news. Walmart-style competition may be on the way in the healthcare business.
The Orlando Business Journal writes Wal-Mart exploring private health insurance exchange for small biz.
Wal-Mart is exploring the idea of building a private health insurance exchange tailored to offer cheaper health insurance to small businesses, a vice president told Orlando Business Journal Jan. 11.In Praise of WalmartMarcus Osborne, vice president of health and wellness payer relations for Wal-Mart Stores Inc. (WMT), spoke to OBJ after his keynote speech at the Foundation of Associated Industries of Florida?s 2013 Health Care Affordability Summit. Osborne said Wal-Mart wants to work with insurers and managed care companies to find new, low-cost health insurance options tailored for small companies, which historically have limited options.
The idea is to offer those products through a health insurance exchange ? or as Osborne said, simply a marketplace ? that would leverage Wal-Mart?s buying and marketing power to make the exchanges widely available and used. ?It would allow small employers to piggyback Wal-Mart,? Osborne said. ?We haven?t got it all figured out, but it?s one of the things we?re looking at.?
?The biggest problem today small employers face from a health insurance perspective is they have no alternatives,? Osborne said. ?If they find anything, they?ve got to take it. There?s something wrong with that.?
Obamacare is going to raise the cost of healthcare. Walmart will lower costs. I have been waiting for this since Summer of 2008.
Flashback June 22, 2008: Trade Wars, Health Care, and Wal-Mart
This post is about trade wars, tariffs, health care, and Wal-Mart. I will tie these themes together starting with a look at Wal-Mart and health care.Hopefully a good idea, long overdue, is about to happen. I repeat what I said in 2008: "We do not need higher wages or higher prices. We need lower prices and a dollar that buys more".I have many disagreements with Jim Jubak, but he hits the nail on the head with Let Wal-Mart fix US health care.
I know who can fix our broken health care system -- and who can't:Inquiring minds will want to read the rest of the article. It's surprisingly good.I say, let Wal-Mart Stores (WMT) do it. Hold your guffaws. Stifle your impulse to scoff. Control those sputters of rage.
- Not presumptive Republican nominee John McCain. He proposes a tax credit of $5,000 per family to encourage us to buy private health insurance.
- Not Democratic presidential candidate Hillary Clinton. She proposes universal health insurance supported by tax credits.
- Not Democratic presidential candidate Barack Obama. He proposes a mix of public and private health insurance with government subsidies to those who don't qualify for government insurance plans such as Medicaid.
Wal-Mart has done more to expand coverage and lower costs in the past year than any government program to come out of Washington in the past 10 years. And I'd bet the new programs that this company -- known for stiffing its own part-time workers on health care benefits -- has announced in the past year will do more to expand coverage and cut costs than anything likely to come out of a McCain, Clinton or Obama first term.
Letting Wal-Mart run the health care system would fix many of those problems. It's a company that understands how low prices can build market share and thus increase profits. Furthermore, it's a company with a culture of cutting costs that has shown no compunction in pushing suppliers to the wall over price. The Wal-Mart motto ought to be, "Make it cheaper, or we'll find someone who can." I'd love to see that attitude brought to bear in health care.
Jubak makes a compelling case. He never said this explicitly but I will. "We do not need higher wages or higher prices. We need lower prices and a dollar that buys more".
Walmart-style competition would do just that.
My primary fear is regulators will kill the idea based on trumped up charges of some sort (or bribes from healthcare providers who fear competition) before the idea takes hold.

It seems like the last few years ?have seen a plethora of lawsuits between major players against smaller competitors who have started to encroach upon their business. I have written about Symantec vs Veeam/Acronis in the past and I continue to have a keen interest in the use of patent infringement law and its deployment as a weapon against competitors. Let me preface the following by saying that a company has every right to litigate against another that infringes upon their intellectual property.?I do believe that there are legitimate cases to be made for infringement, but I also believe that the process in which overly broad patents are awarded is broken to the point that its harmful to innovation and a competitive and open playing field for businesses today.?Patent trolls continue to abuse the system and are a significant problem that has yet to be addressed fully.
But what really gets my goat:
Is selective patent enforcement. I believe that if anyone infringes on your licensed intellectual property and you bring suit, then you should not be only able to selectively enforce the patents against a select group. Meaning, if two companies are infringing on your technology you should have to sue both of them, not just the one you want to punish. ?Also, if let?s say Company A has a technology that they license to Company C, and it infringes on say Company B?s technology ?then Company A should be on the hook for legal costs associated with any suit. This tends to not be the case in many instances, especially in manufacturing where contacts will have liability limit clauses.
If it sounds convoluted and confusing, it kind of is. Legal fees for a basic defense can rack up quickly into the multi-millions, and in many cases the only group who comes out on top financially is the attorneys who get to reap hundreds of hours of fees as well as payments to legal experts who testify.? The perceived tendency is for both parties to reach agreement without going to trial, as it saves considerably on costs, but there are always those cases where one company will refuse to settle regardless of benefit, and are using the legal system to put a company out of business or punish them. Sometimes it?s not even due to any loss of business, it?s simply personal
Time for some rank speculation on my part:
Now as for EMC vs Zerto: reading through the initial filing, I think the case could be made for an infringement claim on its face, but I think it could also be ?personal?. I have friends who work at both companies, so it?s one of those delicate situations to discuss. Also, the problem with a simple filing is that it provides only one side of the story and so far I?ve not seen any legal response to the initial filing so its hard to see where both parties are coming from.
Sometimes you can read through the lines to get the general impression of whats at stake. The simple ?story revolves around 3 patents all stemming from Recovery Point Manager which is an EMC product that both of the primarily founders of Zerto worked on while at EMC. I think the key factor here is that EMC bought Kashya (where the Zerto Founders came to EMC) and in turn own certain technologies that EMC is stating that Zerto is infringing upon.
To me, a case like this should be pretty straight forward and will hinge on independent code review to see if the technology indeed infringes.? Still, I can?t help but think that Zerto?isn?t?cutting too much into EMC?s bottom line (I?d think more VMware and their SRM product), but given the history of the relationships between the parties involved, this may just be ?personal?.
I?d hazard a guess that the vast majority of people who read this had no idea that the two companies were engaged in legal processes, and I have not seen much if anything in the trade press regarding this suit. It was only brought to my attention via discussion on twitter. Technology is a tough business, stuff like this makes it tougher. I?m interested to see where this goes because I know a lot of people like the Zerto product, and they have gained significant?momentum?with their Best of VMworld 2011 win.?I will simply have to wait and see what comes next.

Mrs. Obama has bangs: Let the analyzing begin
NEW YORK (AP) ? Before we start rambling on obsessively about Michelle Obama's bangs, let's be clear: The president started it.
It was he, after all, who called the new hairdo, unveiled just a few days before the historic occasion of his second inauguration, "the most significant event of this weekend."
And he hasn't stopped there. On Tuesday night, he introduced his wife at the Staff Inaugural Ball: "And the First Lady of the United States, bangs and all..."
So given the president's evident interest in the subject, perhaps the rest of us shouldn't feel so bad about analyzing ad nauseum the first lady's new look, an activity that has certainly taken over social media for days (and, perhaps, ended discussion of an earlier obsession, Michelle Obama's arms.) Heck, the bangs even have their own (unauthorized) Twitter account, FirstLady'sBangs, which has taken to issuing dispatches like: "Just got a text from Hillary Clinton's side-part" or "BREAKING NEWS: Barack just named me director of Hairline Security."
And how about the headline in New York's Daily News, the day after Obama's private swearing-in? "In With A Bang."
Quips and clever headlines aside, everyone seems to have an opinion about the new style ? not only how it looks, but what it means. And so, just because it's fun, we analyze some of them here:
THE YOUTH FACTOR: It's no secret, say fashion experts, that on the right person, bangs can make you look younger. It's also no secret that Mrs. Obama turned 49 the very day she unveiled the cut last week, in a photo tweeted from her new Twitter account, FLOTUS.
"None of this is accidental," says Linda Wells, Allure magazine's editor-in-chief. "She tried this on her 49th birthday. She wants to spice it up a bit. And it's definitely a more youthful style than what she had before. It just has a flirty, young quality to it."
THE FASHION PLATE: Clearly Mrs. Obama, well known and admired for her fashion sense, is aware that bangs are in these days. Sure, they've been around forever, and your 5-year-old may have them, but recently bangs have become a full-fledged fashion trend, with actress Zooey Deschanel one of the standard-bearers. (Fun fact: Deschanel, 33, and Mrs. Obama happen to share the same birthday ? Jan. 17.)
"Bangs have always been there, but they are clearly having a moment right now," says celebrity hairstylist Harry Josh, who was in Washington to style singer Kelly Clarkson's hair for the inauguration (Clarkson sang "My Country, 'Tis of Thee.") "Mrs. Obama is really being modern and fashion-forward. We haven't had a fashion-forward first lady like this since Jackie Kennedy."
New York hairstylist Robert Stuart agrees. "Bangs have been really, really big for about a year," he says. He thinks Mrs. Obama has picked the perfect cut for her looks. "It's much softer and younger, and it makes her look more approachable," Stuart says. "It also works well for her sense of fashion. And it brings out her eyes."
THE NAYSAYERS: Just in case one thinks everyone loves the hairdo ? and the reaction does seem extremely positive ? there are naysayers. Count among them Joan Rivers, comedienne and fashion commentator, who tweeted on Inauguration Day: "Today starts President Obama's next four years in the White House. Let's hope the same isn't true about the first lady's new hairdo." Explanation? She didn't provide one, but in her defense, she only had 140 characters.
SHE'S EXPRESSING HER INNER SELF: Here we get a little more philosophical. Some have speculated that, since Mrs. Obama is starting a second term and won't have to endure any more campaigns, she's finally free to express herself exactly as she wants ? and feels. "Haircuts do express how people are feeling," says Wells. "You get that sense of her feeling liberated ? more comfortable, and less worried about what everyone else is thinking. She's showing her own sense of style and own sense of energy."
Stuart, of the Robert Stuart Salon, has a similar thought. "I think now she's maybe feeling less threatened, and can express herself more. Really she just seems more comfortable."
IT'S SOMETHING TO EVERYONE: If you'd wandered around the National Mall on Inauguration Day, and spoke to women especially, you'd have found a lot of Michelle Obama fans. No surprise there. But many of these women were also fond of the bangs, and for various reasons.
Sheila Garrison, an educator from Maryland, called the hairstyle "different," but all the attention paid to it brought home to her and her friend, fellow teacher Patricia Cooper, that Mrs. Obama "represents women in a beautiful way," in Cooper's words. "You look at her and you are proud to be a woman. She commands respect." Garrison, 58, also appreciated how Mrs. Obama, a fellow tall woman, "carries herself really well."
Mattece Mason, 34, of Tulsa, Okla., adores the cut ? when asked about, it she and her family members ? well, the females ? screamed, "Oh my God, we love it!" But the enthusiasm of her daughters was meaningful to Mason for a reason other than fashion. "My daughter Aubrianna, who's 14, said to me today: 'I want bangs now,'" Mason said. "That made me feel great because my girls have such a role model. A first lady they can emulate." (Mason also mentioned she thought Secretary of State Hillary Rodham Clinton looked great in those eyeglasses she's been sporting lately.)
And Roslyn Snow, of Newport Beach, Calif., had another reason for loving the new Obama look. "I think she looks like Jane Fonda back in the old days," said Snow, 76. "Remember?"
A SIGN OF SOMETHING BIGGER?: Many have wondered whether Mrs. Obama has plans to forge a new role in the second term, taking on different issues. Wells, the fashion editor, gets that feeling, though she makes clear it's all speculation. "You sense it with the strong statement she is making with her appearance," Wells says. "Before, her look was sort of retrograde: the hair, the A-line dresses. The emphasis was on 'lady.' Now, it seems, the emphasis is on 'first lady.'"
A POLITICAL STATEMENT?: Josh, Clarkson's stylist, likes to see a broader message in the haircut choice. "Think about President Obama's statement in his speech about gay people as equals. It was so forward-looking. Mrs. Obama was saying something similar, I'd like to think. She was putting America into the position of a forward-thinking country."
Or not. "Of course," adds Josh, "she could just have been bored with her hair the old way."

Former players urge Miller be put in Hall of Fame
NEW YORK (AP) ? Baseball players urged that Marvin Miller be put in the Hall of Fame as they spoke Monday night during a memorial for the union leader.
In an auditorium filled with Hall of Famers, dozens of retired and current players, baseball officials, agents and labor lawyers, 13 speakers praised the former baseball union head, who helped players gain free agency in the 1970s and created the path to multimillion-dollar salaries. Miller died in November at 95.
"It is a travesty he is not in the Hall of Fame," former major league player and manager Buck Martinez said during the two-hour program.
Miller has been turned down five times by various Hall of Fame committees that considered baseball executives.
Jim Bouton, who entered the majors in 1962, was critical that Bowie Kuhn, baseball's commissioner from 1969-84, is in the Hall but Miller has been kept out.
"All those policies were not Bowie Kuhn's policies. In fact they were all Marvin's policies because Marvin won every battle he had with Bowie Kuhn," Bouton said. "I think Bowie Kuhn was 0 for 67."
Miller is next eligible to appear on a Hall ballot this December.
Hall of Famers Dave Winfield and Joe Morgan were among those who spoke before a crowd of about 450 at New York University School of Law's Tishman Auditorium. Reggie Jackson, Keith Hernandez, Steve Garvey, Ted Sizemore and David Cone were among the approximately three dozen former players in the audience.
Major League Baseball was represented by executive vice president Rob Manfred and senior vice presidents Katy Feeney and Phyllis Merhige. Also attending were George Cohen, director of the Federal Mediation and Conciliation Service; Toru Matsubara, executive director of Japan's players' association; and Miller's children, Susan and Peter.
Winfield, who used free agency to sign a record-breaking contract after the 1980 season, said Miller taught him life lessons he still thinks of. Winfield addressed the five active players in the audience: Andrew Bailey, Bill Bray, Craig Breslow, Adam Ottavino and Micah Owings.
"Anything you do in life, know where you've come from, where you are and where you're going, and Marvin was able to share that with us," Winfield said. "Know the history of the players' association. Know how you got to where you are today."
A former economist for the United Steelworkers Union, Miller spent 16 1/2 years as executive director of the Major League Players Association, starting in 1966.
During Miller's tenure, the average major league salary increased from $19,000 to $241,000. It was $3.2 million last year. Players remembered his soft-spokeness, how when speaking on the field during spring training he kept lowering his voice to force players to crane their necks to hear.
"Every time somebody signs one of these wonderful contracts, and there are so many of them out there, I think before they get the first check they should have to write an essay on Marvin Miller," said Rusty Staub, a big leaguer from 1963-85.
Current union head Michael Weiner hosted the tribute, which included video clips taped in 2010 of Miller reminiscing. Players spoke in order of when they made their big league debuts.
"We could have searched 100 years and wouldn't have found a more perfect person for our situation," said Morgan, a Hall of Fame second baseman who played in the majors from 1963-84.
Donald Fehr, who served as Miller's general counsel from 1977-82 and then headed the union from 1983-09, said he could read Miller's mood by what drink he ordered at lunch: a Tom Collins signaled a happy mood, a martini meant he was perplexed and Old Grand-Dad Bourbon was a sign of problems.
"The reason I think he is remembered as he is, is that the baseball players' association became a symbol, it became a symbol of what a union could be if it was run right," said Fehr, current head of the NHL players' union.
Martinez talked about a telephone call he received from former Oakland Athletics owner Charlie Finley during the 1985 labor negotiations.
"You tell Marvin to stick by his guns," Martinez recalled Finley saying. "You guys are doing the right thing."

Charles Taylor appeals war crimes conviction
LEIDSCHENDAM, Netherlands (AP) ? Prosecutors urged judges Tuesday to reject former Liberian President Charles Taylor's appeal against his war crimes conviction and 50-year prison sentence, saying the court should hold "lords of war" as responsible for atrocities as the machine gun-wielding killers they support.
Taylor was found guilty in April 2012 of aiding and abetting Sierra Leone rebels, becoming the first former head of state since World War II to be convicted by an international war crimes court. He was convicted of 11 counts of war crimes and crimes against humanity, including murder, rape, torture and the use of child soldiers.
But as Taylor watched silently from his seat in the courtroom Tuesday, one of his lawyers, Christopher Gosnell, said judges at his trial had a "deep and fundamental" misunderstanding of the notion of "aiding and abetting." He compared Taylor's actions with those of other governments that provide support to rebel groups.
Taylor's defense lawyers have put forward 45 reasons to appeal his conviction and sentence, while prosecutors argue the Special Court for Sierra Leone should have found Taylor guilty of ordering and instigating crimes.
Prosecution lawyer Nicholas Koumjian said Taylor's lawyers want to water down years of international jurisprudence with their argument that he should not be convicted of aiding and abetting atrocities because a greed for diamonds and not blood lust led him to support rebels responsible for murdering and mutilating their enemies in Sierra Leone's decade-long civil war that ended in 2002 with some 50,000 dead.
Prosecutors want Taylor's 50-year sentence ? already effectively a life sentence for the 64-year-old former president ? raised to 80 years to send a message to leaders who facilitate atrocities.
"Those are the promoters of war, the lords of war that sell arms to groups engaged in these conflicts," he said.
Koumjian's comments aimed to counter Taylor's arguments that he should not have been convicted because his support for rebels was not deliberately designed to have them kill and maim.
Gosnell said for judges to convict Taylor of aiding and abetting crimes, his help must be "connected to a specific crime and there must be a substantial contribution to that crime."
Instead, he said trial judges applied a standard "so broad that it would in fact encompass actions that are today carried out by a great many states in relation to their assistance to rebel groups or to governments that are well known to be engaging in crimes," Gosnell said.
In their written appeal, Taylor's lawyers said "the Trial Chamber's approach extends criminal liability far beyond its proper bounds as recognized in international law."
Taylor's lawyers also argued that his conviction was based in part on uncorroborated hearsay evidence that should not have been admitted. They have asked judges to overturn all of Taylor's convictions.
The appeals chamber is expected to take months to reach its judgment.

Stocks ended higher on Wall Street Tuesday as strong earnings reports from big US companies gave investors a boost.?Some homebuilder stocks fell after the National Association of Homebuilders said sales of previously occupied homes dipped.

DuPont, Verizon and Travelers Cos., three of the 30?stocks?that make up the Dow, closed higher after reporting their financial results for the final quarter of 2012.
The Dow closed up 62.51 points, or 0.5 percent, at 13,712.21. The Standard & Poor's 500 index gained 6.53, or 0.4 percent, to 1,492.51. The Nasdaq composite average rose 8.47, or 0.3 percent, to 3,143.18.
The indexes spent the morning edging between small gains and losses. Around noon, the Dow rose decisively and stayed higher for the rest of the day.
Earnings have been strong enough this season to drive a five-day winning streak for the S&P 500 and put the Dow on track for its biggest monthly percentage gain since October 2011. Jack Ablin, chief investment officer at BMO Private Bank in Chicago, said traders have been encouraged by the number of companies beating analysts' profit expectations.
"Granted, we have diminished expectations, but companies are doing a decent job beating on the profit side," he said. The revenue side of the equation has been weaker, Ablin said, preventing a stronger updraft forstocks. Traders might gain more confidence if companies reported stronger demand from emerging markets and Europe, he said.
"The U.S. has been pulling this wagon by itself for the last couple years, and now we're facing some austerity measures. We could certainly use a hand," he said.
Among the Dow components that reported early Tuesday, chemical and bioscience company DuPont reported a sharp drop in net income on weakness in its electronics, communications and other businesses, but the results still beat analysts' forecasts. DuPont's?stock?closed up 83 cents, or 1.8 percent, at $47.82.
Johnson & Johnson said higher sales helped boost its profit from a year ago, when results were weighed down by a slew of one-time charges. However, the company's 2013 profit forecast fell short of analysts' estimates. J&J dropped 54 cents, or 0.7 percent, to $72.69.
Verizon Communications Inc. rose after the country's biggest wireless carrier said it activated a record number of new devices on contract-based plans in the fourth quarter. Verizon's net loss widened on restructuring and pension costs and expenses related to the cleanup from Superstorm Sandy. Its?stock?rose 40 cents, or 0.9 percent, to $42.94.
A fourth member of the Dow 30, property and casualty insurer Travelers Cos., rose strongly after it said core income categories like investments and premiums written rose. Net income fell because of claims filed in the wake of Superstorm Sandy. The?stock?shot up $1.64, or 2.2 percent, to $77.95, an all-time closing high. Travelers has risen nearly 27 percent over the past 12 months.
The market was closed on Monday for the Martin Luther King Jr. holiday.
Yet another company hit by Superstorm Sandy was Delta Air Lines, which said its fourth-quarter profit was nearly wiped out after it was forced to cancel more than 20,000 flights. The storm hit Delta harder than other airlines because it slowed operations at Delta's new oil refinery near Philadelphia. The results were still better than analysts were expecting. Delta rose 40 cents, or 2.9 percent, to $14.01.
Tech behemoths Google and IBM reported solid earnings gains after the market closed. Tech companies' results are being watched closely because many of them have warned about a weak fourth quarter.
Google soared after saying its fourth-quarter earnings rose 7 percent as online advertisers spent more money in pursuit of holiday shoppers. The?stock?gained $29.13, or 4.1 percent, to $732 in after-hours trading.
IBM said its net income rose 6 percent. The?stock?rose $6.82, or 3.5 percent, to $202.90 in late trading.
Apple reports after the bell Wednesday.
Freight rail companies are another key category at this stage in the economic recovery. They are seen as a proxy for the broader economy because their results track the demand for transportation of materials used in manufacturing and goods sold to consumers and businesses.
Two big railroads reported after the closing bell. CSX gained 74 cents, or 3.6 percent, to $21.55 in after-hours trading after beating analysts' expectations. Norfolk Southern rose $1.05, or 1.6 percent, to $67.99 after the bell.
Some homebuilder?stocks?fell after the National Association of Homebuilders said sales of previously occupied homes dipped to an annual pace of 4.94 million in December from 4.99 million in November. November's figure was revised lower, but was still the highest in three years.
Lennar Corp. fell a penny to $42.07. Hovnanian Enterprises Inc. lost 6 cents to $6.24.
The yield on the benchmark 10-year Treasury note was unchanged at 1.84 percent.
Benchmark oil rose 62 cents to $96.66 on the New York Mercantile Exchange, as global economic reports remained generally positive.

WASHINGTON: The Assistant Secretary for Special Education and Rehabilitative Services has proposed that ?inclusive Cloud and Web computing? be a priority for the federal Disability and Rehabilitation Research Projects (DRRP) and Centers.
In the United States, people classified as ?disabled? are accessing the World Wide Web 23 percent less than the rest of the population, according to the National Broadband Plan and a 2010 Federal Communications Commission report.
?One reason for the disparity is that the Web infrastructure is not set up to address disability access issues seamlessly across all of its functions,? the Department of Education?s Office of Special Education and Rehabilitative Services explained. ?Additionally, software and devices (e.g., computers, smartphones and tablets) used to access the Web are often inaccessible for people with disabilities, and individuals with disabilities have limited access to technical assistance with selecting, setting up and using appropriate technologies.?
In addition, the Department of Education said, ?People with disabilities often are required to purchase separate accessibility software and assistive devices for each device they use to access the Web, which adds to the economic burden of Web use by people with disabilities.?
One possible answer lies in Cloud computing, a technology used to store, access and process information on the Web. Cloud computing carries the potential to enhance Web participation by people with disabilities by providing an infrastructure that better supports accessibility for this population.
The Assistant Secretary for Special Education and Rehabilitative Services proposed the research project under the Disability and Rehabilitation Research Projects and Centers Program administered by the National Institute on Disability and Rehabilitation Research. The proposed project, based on Cloud and Web inclusion, is intended to contribute to improved employment outcomes for individuals with disabilities.
The Assistant Secretary has also proposed the process of Knowledge Transfer, which ensures new knowledge and products gained through research and development will ultimately be used to improve the lives of individuals with disabilities.
?Technology transfer is a subset of knowledge translation that focuses on ensuring that technology-based knowledge and products will be transferred into tangible benefits for individuals with disabilities through commercialization, engineering standards, freeware and other tangible applications,? the Assistant Secretary said.

Using a recovery-based approach, the Mental Health Worker assists members to develop and use interpersonal, social, and leadership skills that will optimize their strengths and improve their quality of life, and mental and physical health and well being. The Mental Health Worker collaborates with a range of formal and informal services, refers members to external resources, and may also participate in case conferences and systemic initiatives to improve availability, accessibility, and equity of resources.
From time to time, the Mental Health Worker may be required to handle conflicts in the Program, and intervene in crisis situations.
In addition to compliance with all organizational policies and procedures, the incumbent is also expected to behave ethically, demonstrate competence in effective communication and team building, demonstrate effectiveness in working in a collaborative environment, and demonstrate confidence in decision-making and in building relationships.
This position reports to and is supervised by the Program Manager.

Requirements:
? Degree or diploma in health or social services
? Degree plus four (4) years experience in a community-based organization working with adults with serious mental illness
? Diploma plus six (6) years or more experience in a community-based organization, working with adults with serious mental illness
? Current registration with the OCSWSSW or a regulatory body under the Regulated Health Professions Act
? Education and experience related to supportive counseling, community development, crisis prevention, advocacy, multicultural issues and consumer empowerment is preferred
? Knowledge of systemic issues such as poverty, unemployment, stigma and the isolation felt by individuals with serious mental illness and their families
? Knowledge of the Ontario Mental Health Act, mental health reform principles, the Substitute Decisions Act, and the Health Care Consent Act and PHIPA requirements
? Knowledge of PSR and Recovery as guiding principles
? Ability to apply Recovery principles and empowerment oriented philosophies and practices in work with consumers
? A second language reflecting the local community is an asset
? A valid Canadian driver?s license, a minimum $1,000,000 third party liability insurance and proof that insurance covers use of personal vehicle to transport clients

- A hospice palliative care home visiting volunteer* providing emotional, social, spiritual and practical (non-medical) support for people living with a life-threatening illness, their caregivers and families.
- A bereavement peer facilitator** providing one to one support and/or co-facilitating mutual support bereavement groups for people grieving the loss of someone significant to them.

We know that with the right support, services and information, caring for someone at the end of life can be manageable and meaningful for all involved. Required Qualifications:
- Post Secondary diploma/degree in the social services field plus
- Minimum of two (2) years of related experience or equivalent in: developing effective client specific plans and court reports, counselling, case management, risk assessment, community outreach and community development, working cooperatively with community service providers in the provision of service to young persons involved in the youth criminal justice system
- Working knowledge and good understanding of the criminal justice system and social service agencies and the principles of risk, need, and intervention for at-risk/high risk youth.
- Assessment skills required for both the delivery of service to young persons and daily operational/programming issues, including determination of client suitability and risk.

RESPONSIBILITIES

Our counsellors provide high quality professional telephone, web and chat-line counselling, education /referral to children and youth contacting Kids Help within a context of protection and empowerment of children and families to support the care of children and adolescents. The successful incumbent will provide assessment, counselling and support to children and youth in crisis and where appropriate provide referral to local community services to ensure effective professional response to the specific crisis. This includes assisting children and youth in distress and/or requesting supportive and educational services using methods and interventions defined within the context of professional social work practice while incorporating additional skills generally gained through exposure to other ?helping professional practices and methods?, and completing required documentation to support direct service for? telephone,? Web, or? chat-line? interventions. Our Counsellors also attend and participate in case conferences, case supervision and debriefing.

Nature & Scope:
The West End YMCA provides a variety of health, fitness, recreation, and community programs to more than 10,800 members, including children, youth and adults, who represent the diversity of Toronto and its communities.
Reporting to the Health and Fitness Programs Senior Director the Health and Fitness Programs Supervisor (Group Fitness) provides direct leadership to execute all group fitness activities in the facility including group fitness programs and volunteer development in group fitness.? The Supervisor provides a superior experience to our members in General Membership areas. Implementing our Member Insight Strategy and using our Membership Involvement Model, identifies initiatives to increase Membership on Roll, Retention, Satisfaction, and Philanthropic contributions in our Group Fitness Programs.? The Supervisor must ensure that all members of this team are proactive in their ability to stay abreast of leading trends in health, fitness and demonstrate exceptional relationship building skills. The recruitment, development, certification, retention and deployment of a team of volunteers to work in this area is also a major focus of this department. As well as increased class offerings.
Responsibilities:
Develops, implements, monitors and evaluates programs within the Association?s Membership Services Plan, which will attract and retain the diverse membership of the centre.
Provides direct program leadership to a variety of group program areas including group fitness classes and small group training including TRX, Aqua-Fit and Recreational Sports for the equivalent of 60-70% of scheduled shifts.
Provides direct leadership as a YMCA Trainer in Fitness in delivering the YMCA Fitness Leader Certification and works towards the YMCA Training Educator Level.
Assists Health and Fitness Programs Senior Director with recruiting, supervising and developing effective staff and volunteer teams within the department. Maintains records for volunteers using Raiser?s Edge.
Assists Health and Fitness Programs Senior Director in development and management of all performance indicators and standards including those related to group fitness, retention and YMCA Priority Sam standards.
Provides leadership and support as a member of the Centre?s senior staff team. Acts as an effective Service Leader.
Participates in task groups, special assignments and opportunities that further the Association mission, vision and strategic initiatives including the Core Service Functional Group.
Models appropriate behaviours to staff in line with our Mission, Vision and Values; establishes rapport and maintains effective relationship building behaviours with staff and members. Represents the YMCA and the Association in a professional manner.

Qualifications:
- Diploma or Degree in Recreation Leadership, Kinesiology, Physical Education or related field preferred.
- YMCA certification in Group Fitness an asset
- Proficiency in Aquatic Fitness, Adult Programs, and Choreography/Dance Based and Fusion classes an asset
- YMCA Trainer certification an asset
- Significant experience teaching variety of group fitness classes, including CycleFit, Muscle Works, Boxfit and Low/High Impact
- Previous experience in development and implementation of new programs an asset
- Current First Aid and CPR certification; AED training/certification an asset
